These Terms of Service ("Terms") govern your access to and use of Obra, operated by BQ Production LLC ("Obra," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms.

1. Service Description

Obra is a platform providing AI-powered tools designed for contractors, remodelers, and construction professionals. Our services include photo comparison and analysis, project report generation, cost estimation, social media content creation, review request generation, sketch cleanup, social media analysis, and an AI chat assistant.

2. Eligibility

You must be at least 18 years of age to create an account and use Obra. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

• You may register using your email address or Google OAuth
• You are responsible for maintaining the security of your account
• You must provide accurate and complete information
• One account per person; sharing accounts is not permitted
• You are responsible for all activity under your account

4. Credits and Pricing

Free Credits

New users receive 5 free credits upon registration. Free credits are one-time and do not renew.

Credit Packs

• 25 credits — $4.99
• 60 credits — $9.99
• 150 credits — $19.99

Pro Subscription

Pro subscription provides 50 credits per month for $14.99/month, auto-renewed on the billing date.

Credit Terms

• Credits are non-refundable once purchased
• Credits are non-transferable between accounts
• Unused credits expire after 12 months of account inactivity
• Credit costs per action are displayed before each use; you must confirm before credits are deducted
• We reserve the right to modify credit pricing with 30 days' notice

5. Payment

• PayPal: Payments processed through PayPal's secure platform. We do not store payment card information.
• All prices are in US dollars
• Taxes are the responsibility of the user where applicable

6. AI-Generated Content Disclaimer

IMPORTANT: All content generated by Obra — including cost estimates, project reports, photo analyses, social media captions, and chat responses — is produced by artificial intelligence models and is provided for informational and reference purposes only.

• AI outputs are estimates and suggestions, not professional advice
• Cost estimates may not reflect actual market prices in your area
• Reports are not a substitute for licensed contractor, engineer, or architect assessments
• AI analyses should be verified by qualified professionals before making business decisions
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content
• Obra is not a licensed contractor, engineer, architect, or financial advisor

7. User Content

• You retain ownership of all photos, text, and data you upload to Obra
• By uploading content, you grant us a limited license to process it through AI services for the purpose of providing our tools
• If you opt into the public Contractor Directory, you grant us permission to display your business information publicly
• You represent that you have the right to upload any content you submit
• We may remove content that violates these Terms without notice

8. Prohibited Use

You agree not to:

• Upload illegal, harmful, threatening, abusive, or defamatory content
• Use AI tools to generate fraudulent estimates, fake reviews, or misleading content
• Attempt to reverse-engineer, exploit, or abuse the AI systems
• Use automated scripts, bots, or scrapers to access Obra
• Circumvent rate limits or credit systems
• Impersonate other users or businesses
• Use the service for any purpose that violates applicable law
• Share your account credentials with others

9. Refund Policy

• Used credits: Non-refundable. Credits are consumed immediately upon AI processing.
• Unused credit packs: Non-refundable as digital goods delivered immediately upon purchase.
• Pro subscription: You may cancel at any time. No refund for the current billing period. Service continues until the end of the paid period.
• Exception: If a technical issue on our side prevents you from using purchased credits, contact us at fanzai.mgmt@gmail.com for resolution.

10. Intellectual Property

• Obra, its design, code, and branding are the property of BQ Production LLC
• You may not copy, modify, or distribute any part of our platform
• AI-generated content created using your inputs belongs to you for commercial use
• "Obra" and "BQ Production" are trademarks of BQ Production LLC

11. DMCA and Copyright

If you believe content on Obra infringes your copyright, please send a DMCA takedown notice to fanzai.mgmt@gmail.com with:

• Description of the copyrighted work
• Location of the infringing material on our platform
• Your contact information
• A statement of good faith belief that the use is unauthorized
• Your physical or electronic signature

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BQ PRODUCTION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OBRA.

Our total liability for any claim arising from these Terms shall not exceed the amount you have paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

13. Disclaimer of Warranties

OBRA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Account Termination

• You may delete your account at any time by contacting us
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use Obra ceases immediately
• We may retain certain data as required by law or for legitimate business purposes
• Unused credits are forfeited upon account termination for Terms violations

15. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Continued use of Obra after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Los Angeles County, California.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
